Terms & Conditions of Service

Last updated: 26 October 2026

Welcome to the Nimbus Earth Agriculture platform (formerly OPAL). These Terms and Conditions govern your use of the Nimbus Earth Agriculture Progressive Web Application and its related services, which are owned and operated by Blackscape Ltd, trading as Nimbus Earth ("we", "us", "our"). By accessing or using Nimbus Earth Agriculture, you agree to be bound by these terms. If you do not agree, you must immediately cease using the platform.

1. Services provided

Nimbus Earth Agriculture provides agricultural analytics based on satellite observations, including spectral index computations (Sentinel-2) and soil-moisture models (Sentinel-1), alongside meteorological forecasts (Open-Meteo) and historical weather (NASA POWER). The service is designed to support farmers and agricultural consultants.

Weather data by Open-Meteo.com, licensed under CC BY 4.0; forecasts for the UK and Ireland contain Met Office data, licensed under CC BY-SA 4.0. Historical weather data was obtained from the National Aeronautics and Space Administration (NASA) Langley Research Center (LaRC) Prediction of Worldwide Energy Resource (POWER) Project funded through the NASA Earth Science/Applied Science Program.

Map search: postcode locations by postcodes.io — contains OS data © Crown copyright and database right, Royal Mail data © Royal Mail copyright and database right, and National Statistics data © Crown copyright and database right, licensed under the Open Government Licence v3.0. Funding rates and animal-disease notices from GOV.UK (Defra, APHA, RPA) contain public sector information licensed under the Open Government Licence v3.0; notices are shown as published and GOV.UK remains the authoritative source. Nimbus Earth Agriculture is a decision-support tool, not agronomic advice. Every figure the platform produces — index values, soil-moisture estimates, biomass and forage calculations, irrigation timings, growth stages, alerts and reports — is a model output derived from remote observations and weather forecasts. It is an input to your judgement, not a substitute for it.

Satellite and model outputs carry inherent uncertainty. Cloud cover, revisit gaps, sensor geometry, soil and canopy conditions, and the accuracy of third-party weather forecasts all affect results, and the underlying coefficients are calibrated to regional averages rather than to your specific field. Ground verification remains the sole responsibility of the grower.

You are solely responsible for every agronomic, irrigation, grazing, input-purchase, harvest and commercial decision you make, whether or not it was informed by Nimbus Earth Agriculture. Where a decision carries material cost or risk, verify in the field and consult a qualified agronomist before acting.

2. Intended users — business use

Nimbus Earth Agriculture is supplied for business and professional use by farms, agricultural businesses, cooperatives and agronomic consultants. It is not designed, marketed or sold for personal, household or domestic use, and by subscribing to a paid plan you confirm that you are acting in the course of a business.

Where you nevertheless deal with us as a consumer, nothing in these terms removes or limits any right you have under the Consumer Rights Act 2015 or other consumer protection law that cannot lawfully be excluded, and those rights prevail over anything below that conflicts with them.

3. Account access

Access to Nimbus Earth Agriculture is granted to registered, approved subscribers. New accounts are initially marked as pending status. We reserve the right to approve, reject, block, or limit access to accounts at our sole discretion.

Team workspaces (Business plan). A Business subscription allows the account owner to invite up to three additional people, each signing in with their own account, to work on the owner's fields. Invited members act on the owner's data with the owner's authorisation; the owner is responsible for who they invite and may remove a member at any time. Team access ends immediately when a member is removed or leaves, when the owner's subscription no longer includes team seats, or when the owner's account is deleted.

Downgrades and subscription changes. If your subscription ends or changes to a plan with lower limits, your data is retained, not deleted. Fields or features that exceed your new plan's limits become read-only: existing data remains visible, but new analyses, boundary edits, and plan-gated features are unavailable until you upgrade again or remove the excess fields. On a change to a plan without team seats, invited team members are detached automatically.

Inactive accounts. Stored field data has an ongoing cost. Accounts that have not been signed in to for 12 months may be permanently deleted, together with their data, after notice to the account's registered email address.

4. Subscriptions, pricing and payment

Paid plans are not on sale yet. Nimbus Earth Agriculture is in private beta and every account currently uses the service free of charge. The paid-plan provisions in this section, and those in section 3 that depend on a subscription, apply from the date you first subscribe.

Plans. Nimbus Earth Agriculture is offered on the following plans:

Annual plans are charged at ten times the monthly price, so two months are free. The plan limits in force are those shown in the application at the time you subscribe.

Tax. The prices above exclude tax. Applicable taxes are calculated at checkout by Paddle according to your location and status, and shown before you confirm payment — they may include VAT, GST or sales tax, and for some business purchases no tax is charged. Where you supply a valid business tax identification number, it will be applied to your invoice in accordance with the rules of your jurisdiction.

Payment processing — Paddle. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders: it is the seller of your subscription for the purposes of the payment transaction, takes payment, issues invoices and receipts, calculates and collects any applicable sales tax, and handles billing enquiries and refunds. Paddle's Buyer Terms apply to the payment alongside these terms, which continue to govern your use of the service itself. We do not receive or store your card details.

Billing and automatic renewal. Subscriptions are paid in advance. Your plan renews automatically at the end of each billing period — monthly or annually, matching the interval you chose — at the price then in force, and continues until cancelled. We will give at least 30 days' notice by email before any price change takes effect for your subscription, and you may cancel before it applies.

Cancellation. You may cancel at any time from Settings → Plan & Billing → Manage billing. Cancellation takes effect at the end of the period you have already paid for: you keep full access until then, and are not charged again. Your data is retained and your account reverts to the Free plan under the downgrade terms in section 3.

Refunds. Because the Free plan lets you evaluate Nimbus Earth Agriculture before paying, we do not operate a separate trial or general refund period, and payments for started billing periods are not refundable. This does not affect any statutory right you may have, any right granted to you under Paddle's Buyer Terms or Refund Policy, and we will refund billing mistakes and periods in which the service has failed because of a fault on our side. Full details, including how to ask for a refund, are in our Refund Policy.

Failed payments. If a renewal payment fails, Paddle will retry it over a short period and contact you. Access continues during those retries. If every attempt fails, the subscription ends and the account reverts to the Free plan, with data retained as described in section 3.

5. Data and privacy

Our handling of personal data, including the rights available to users, is described in our Privacy Policy.

Permanent deletion warning: under GDPR, you have the right to erase your account at any time. In-app deletion is immediate, irreversible, and permanent. All fields, calibrations, and satellite history will be erased from Firestore. We do not keep offline backup copies of your user data once deleted.

6. Prohibited uses

You agree not to use the platform to:

7. Service availability

Nimbus Earth Agriculture depends on third-party sources we do not control, including the Copernicus Data Space Ecosystem for Sentinel-1 and Sentinel-2 imagery, and Open-Meteo and NASA POWER for weather data. Satellite revisit intervals, cloud cover, scheduled maintenance and outages at those providers can delay or prevent analysis. We provide the service on a reasonable-endeavours basis and do not warrant that it will be uninterrupted, error-free, or that imagery will be available for any particular field on any particular date.

8. Limitation of liability

Nothing in these terms limits or excludes our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; or any other liability that cannot lawfully be limited or excluded. If you deal with us as a consumer, your statutory rights are unaffected.

Subject to that, and because Nimbus Earth Agriculture is a decision-support tool as described in section 1:

Cap on liability. Subject to the first paragraph of this section, our total liability to you in connection with the service, whether in contract, tort (including negligence), breach of statutory duty or otherwise, is limited in aggregate to the greater of (a) the total fees you paid us in the twelve months immediately before the event giving rise to the claim, and (b) £100.

9. Governing law and jurisdiction

These terms and any dispute arising out of them or the service are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.

If you are a consumer resident in the European Union or elsewhere, this does not deprive you of the protection of any mandatory provisions of the law of your country of residence, or of your right to bring proceedings there where the law of that country gives you that right.
